1. OVERVIEW

This website is operated by Raíces Monarca LLC (“Raíces Monarca,” “we,” “us,” or “our”). Throughout the site, the terms “you” and “your” refer to visitors, customers, and other users of our website.

These Terms of Service (“Terms”) govern your access to and use of our website, online store, products, and related services.

By visiting our website, placing an order, or purchasing a product from us, you agree to be bound by these Terms, as well as any additional policies referenced on our website, including our Privacy Policy, Shipping Policy, Refund Policy, and Candle Care & Safety information.

If you do not agree to these Terms, please do not use our website or purchase our products.

2. OUR PRODUCTS

Raíces Monarca LLC creates handcrafted decorative candles, including candles made from 100% beeswax and individually decorated by hand.

Because our products are handmade, slight variations in color, texture, dimensions, shape, placement of decorative elements, and other details are natural and expected. These variations are part of the handmade character of each candle and are not considered defects.

We make reasonable efforts to display product colors and photographs accurately. However, colors may appear differently depending on your device, screen settings, lighting, and other factors. We cannot guarantee that the color displayed on your screen will exactly match the physical product.

Product descriptions, dimensions, and other measurements are approximate unless expressly stated otherwise.

Product availability is subject to change without notice. We may discontinue or modify products at any time.

3. DECORATIVE CANDLES & CANDLE SAFETY

Raíces Monarca LLC candles are handcrafted primarily as decorative products. Some candles may also be burned if the customer chooses to do so.

Burning any candle involves an open flame and carries inherent risks, including fire, burns, hot wax, smoke, and property damage.

If you choose to burn a Raíces Monarca LLC candle, you must follow the safety and care instructions supplied with the product and/or provided on our website.

At a minimum:

  • Never leave a burning candle unattended.

  • Keep candles away from children and pets.

  • Keep candles away from drafts, flammable materials, furniture, curtains, decorations, and other objects that may catch fire.

  • Place the candle on a stable, level, heat-resistant and flame-resistant surface capable of catching melted wax.

  • Keep the wick appropriately trimmed before burning.

  • Keep the candle free of wick trimmings and other debris.

  • Do not move or handle a candle while the wax is hot or liquefied.

  • Discontinue burning if the candle becomes unsafe to continue using.

  • Follow all additional instructions provided with your candle.

Our decorative elements may soften, melt, shift, or fall away as the candle burns. This is an expected characteristic of this style of handcrafted candle.

Purchasing a candle does not eliminate the customer's responsibility to use reasonable care when handling or burning it.

Nothing in these Terms is intended to exclude or limit any liability or consumer right that cannot lawfully be excluded or limited.

4. ORDERS

By placing an order through our website, you represent that the information you provide is current, complete, and accurate.

Submitting an order does not necessarily mean that we have accepted it. We reserve the right to decline or cancel an order for legitimate reasons, including suspected fraud, payment issues, inventory errors, incorrect pricing, product availability, shipping restrictions, or errors in product information.

If we cancel an order after payment has been successfully processed, we will refund the applicable amount to the original payment method, subject to the policies of the payment provider.

Because many of our candles are handcrafted in small batches, quantities may be limited.

We may limit quantities purchased per person, household, order, account, payment method, or shipping address when reasonably necessary to prevent fraud, unauthorized resale, inventory issues, or abuse of promotions.

5. PRICING & PAYMENTS

All prices displayed on our website are listed in U.S. dollars unless otherwise indicated.

Prices may change without notice. A price change will not affect an order that we have already accepted except where permitted by applicable law, such as in the case of an obvious pricing error.

Applicable taxes, shipping charges, and other charges will be shown at checkout when required.

Payment is due at the time an order is placed unless otherwise stated.

Payments may be processed through Shopify Payments or other third-party payment providers available through our store. By submitting payment information, you represent that you are authorized to use the selected payment method.

We do not guarantee that every payment method will always be available.

If a pricing, product, promotional, or other material error appears on our website, we reserve the right to correct the error and, where permitted by law, cancel affected orders and issue any required refund.

6. SHIPPING & DELIVERY

Orders are shipped according to our current Shipping Policy, which is incorporated into these Terms by reference.

Processing times and estimated delivery dates are estimates unless we expressly state otherwise.

Once an order has been transferred to a shipping carrier, delivery may be affected by circumstances outside our reasonable control, including carrier delays, weather, holidays, service interruptions, incorrect or incomplete delivery information, and other events.

Customers are responsible for providing an accurate and complete shipping address when placing an order.

If you notice an error in your shipping information, contact us as soon as possible. We cannot guarantee that an address can be changed after an order has entered processing or has shipped.

Our Shipping Policy contains additional information regarding processing times, delivery, damaged packages, lost packages, and other shipping matters.

7. RETURNS, REFUNDS & DAMAGED PRODUCTS

Returns, refunds, exchanges, cancellations, and damaged-product claims are governed by our current Refund Policy, which is incorporated into these Terms by reference.

Because our candles are handmade, ordinary variations in color, texture, shape, decorative placement, or other handcrafted details are not, by themselves, considered product defects.

If an item arrives damaged, defective, or materially different from what you ordered, please contact us according to the instructions and timeframes contained in our Refund Policy.

We may request photographs of the product, packaging, shipping box, shipping label, or other relevant information so that we can evaluate a claim and, when appropriate, submit a claim with the shipping carrier.

Nothing in our Refund Policy or these Terms limits any rights or remedies you may have under applicable law.

8. PRODUCT PHOTOGRAPHY & HANDMADE VARIATIONS

Product photographs are intended to provide a representative example of our products.

Because every candle is individually handcrafted and decorated, the candle you receive may not be identical to the candle shown in a photograph.

Variations that may occur include, but are not limited to:

  • color or shade;

  • decorative placement;

  • flower or wax-detail positioning;

  • surface texture;

  • minor dimensions;

  • natural beeswax characteristics; and

  • other details resulting from the handmade process.

These natural handmade variations make each product unique.

However, this provision does not apply to material defects, incorrect products, shipping damage, or other circumstances for which you may have rights under our Refund Policy or applicable law.

9. WEBSITE USE

You may use our website only for lawful purposes.

You may not use the website:

  • to engage in fraudulent or unlawful activity;

  • to interfere with the security or operation of the website;

  • to introduce viruses, malicious code, or other harmful technology;

  • to attempt unauthorized access to the website or related systems;

  • to collect or misuse information belonging to other users;

  • to impersonate another person or provide intentionally false information;

  • to infringe our intellectual property rights or the rights of others; or

We reserve the right to restrict or terminate access to our website where reasonably necessary to protect our business, customers, website, or legal rights.

Unless otherwise indicated, the content of this website is owned by or licensed to Raíces Monarca LLC. and is protected by applicable intellectual property laws.

This includes, where applicable, our:

  • business and brand name;

  • logos and brand artwork;

  • photographs and product photography;

  • website graphics;

  • written content;

  • product descriptions;

  • packaging artwork;

  • original illustrations and designs; and

  • other original creative materials.

You may view and use our website for your personal, non-commercial use.

You may not reproduce, copy, distribute, modify, publish, sell, commercially exploit, or create derivative works from our protected content without our prior written permission, except as permitted by law.

Nothing in these Terms transfers ownership of our intellectual property to you.

11. THIRD-PARTY SERVICES

Our online store is hosted through Shopify and may use third-party providers for services such as payment processing, shipping, analytics, website functionality, and other business operations.

Your use of certain third-party services may also be subject to the terms and privacy practices of those providers.

We are not responsible for the independent acts, omissions, policies, availability, or content of third parties except to the extent required by applicable law.

Links to third-party websites are provided for convenience and do not necessarily constitute our endorsement of those websites or their content.

12. ACCURACY OF WEBSITE INFORMATION

We make reasonable efforts to ensure that information on our website is accurate and current.

However, our website may occasionally contain typographical errors, inaccuracies, omissions, or outdated information relating to product descriptions, pricing, promotions, availability, shipping charges, or other matters.

We reserve the right to correct errors, inaccuracies, or omissions and update information when appropriate.

Nothing in this section limits any rights you may have regarding an order already placed or accepted under applicable law.

We do not guarantee that the website will always be uninterrupted, secure, error-free, or available.

To the fullest extent permitted by applicable law, Raíces Monarca LLC will not be liable for indirect, incidental, special, or consequential damages arising solely from the use of or inability to use our website or services.

With respect to our products, customers are expected to follow all product instructions and candle safety precautions and to use reasonable care when choosing to burn or otherwise use a candle.

Raíces Monarca LLC is not responsible for damage resulting solely from misuse of a product, failure to follow provided safety instructions, unauthorized modification of a product, or use of a product in a manner that is clearly inconsistent with its intended use, to the extent permitted by law.

Nothing in these Terms excludes, restricts, or limits liability for personal injury, defective products, negligence, breach of warranty, or any other matter to the extent such liability cannot legally be excluded, restricted, or limited.

Your statutory consumer rights are not affected by this section.

15. INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless Raíces Monarca from third-party claims, losses, liabilities, or reasonable expenses arising from your unlawful use of our website, your violation of these Terms, or your infringement of another person's rights.

This section does not require you to indemnify Raíces Monarca LCC for liability caused by Raíces Monarca's own negligence, unlawful conduct, or other liability that cannot lawfully be shifted to you.

Your submission of personal information through our website is governed by our Privacy Policy.

Our Privacy Policy explains how personal information may be collected, used, disclosed, and protected when you interact with our store.

17. PROMOTIONS, DISCOUNTS & GIVEAWAYS

From time to time, Raíces Monarca LLC may offer discount codes, promotions, giveaways, or other special offers.

Additional rules or eligibility requirements may apply to individual promotions.

Unless otherwise stated, promotional offers:

  • have no cash value;

  • cannot be combined with other promotions;

  • may be limited to one use per customer or order;

  • may exclude certain products; and

  • may expire or be discontinued according to their stated terms.

Giveaways may be subject to separate official rules, eligibility requirements, entry periods, and restrictions. Where separate giveaway rules are provided, those rules govern the applicable promotion.

We do not guarantee that any particular product will remain available indefinitely.

These Terms, together with our Privacy Policy, Shipping Policy, Refund Policy, Candle Care & Safety information, and any other policies expressly incorporated into these Terms, constitute the agreement governing your use of our website and purchases from our online store.

23. GOVERNING LAW

These Terms and transactions with Raíces Monarca LLC are governed by the laws of the State of Oregon, without regard to conflict-of-law principles, except where applicable federal law or another jurisdiction's mandatory consumer-protection laws apply.

Nothing in this section deprives a consumer of protections or rights that cannot lawfully be waived by contract.
